Justices Mull Kentucky Arbitration Rule In Wrongful Death Case

W&M attorney Rob Salyer argued before the U.S. Supreme Court over the issue of arbitration agreements in Kentucky. The state’s rule and its highest court both indicate that people who have power of attorney over someone in a nursing home do not have the authorization to sign an arbitration agreement unless the power of attorney contract explicitly says as much.

The attorney for the nursing home company argued that reasoning is at odds with the Federal Arbitration Act.
