Arizona Supreme Court reinstates W&M wrongful death case against nursing home

W&M attorney Mary Ellen Reilly won an appeal to the Arizona Supreme Court in a case involving the wrongful death of a woman at a ManorCare nursing home in Tucson. The Pima County court granted ManorCare a summary judgment, but the Court of Appeals determined there was grounds to go to trial. The Supreme Court, in agreement with the Court of Appeals, reversed the decision and concluded the family has ample cause to file a lawsuit against the nursing home. In its decision, the court noted that medical records and expert affidavits demonstrated that ManorCare provided inadequate treatment for the woman. The case was remanded back to the Superior Court for further deliberation.
